Class Action Lawsuit Against Whirlpool
A class action lawsuit has been filed in federal court in Fort Smith against Whirlpool Corp on behalf of refrigerator owners nationwide.
The complaint, filed Monday with U.S. District Court in the Western District of Arkansas, the plaintiffs state that the icemakers in the refrigerators do not work and the temperature controls fluctuate, “which leads to flooding and water and property damage to the home.” They state further that the defect renders the refrigerators “unable to perform the ordinary purposes for which they are used.”
The plaintiffs assert that Whirlpool knowingly breached warranties by marketing and selling defective refrigerators, committed negligence by not disclosing the “foreseeable risks of property damage to customers’ homes,” engaged in unfair or deceptive trade acts or practices in violation of Arkansas code and received unjust profit by accepting payment for defective refrigerators.
The plaintiffs seek unspecified restitution, damages, attorney’s fees and other relief.
