Class Action Lawsuit Filed Against Hospital For Negligence
Regional Health Authority 7 faces a class action lawsuit for allegedly providing incorrect pathology work at the Miramichi Regional Hospital. The lawsuit has charged the pathologist Dr. Rajgopal Menon, in particular. The lawsuit seeks compensation on behalf of nearly 50 patients in the year 2004 and 2005. Menon was responsible for diagnostic testing of 24,000 pathology samples between 1995 and 2007.
The lawsuit accuses the hospital of negligence in hiring Menon in 1994 against the advice of its vice-president, Dr. John MacKay at the time. The lawsuit also claims that an inadequate background check was performed and that the authority ignored warnings and cautions from Menon’s previous employer, the Saint John Hospital. The authority is also accused of not acting quickly enough to respond to possible inaccuracies in Menon’s work. An independent audit launched last December showed discrepancies in 18 per cent of 227 prostate and breast cancer cases under Menon’s care in 2004-05.
