Employment laws likely to go various changes in US

For the past few months,the employers have to experience a drastic change in employment legislation. A number of laws are going to be changed in recent times.Some of the laws are; Sex Discrimination Act, enhanced maternity rights, Immigration, Asylum and Nationality Act, Corporate Manslaughter and Corporate Homicide Act and awaited changes in the Employment Act and the new Single Equality Act.

The Single Equality Act is also due to come into force in stages throughout 2009, which will bring major changes in the legislative framework dealing with discrimination law.The existing laws will be consolidated into one Single Equality Act, which will also address areas which are not currently dealt with by Parliament.

Other legal changes that are affecting employers across Wales include changes that have recently been made to the Sex Discrimination Act 1975. The changes impose liabilities on employers who fail to protect their employees from sexual harassment by third parties, such as customers or clients.

Enhanced maternity rights are also to be given to all female employees whose babies are due on or after October 5, entitling them to retain all of their contractual benefits, including accrual of holiday pay throughout the whole of their maternity leave, although this does not extend to remuneration throughout the whole 12 months of maternity leave.
Individual employees and company directors need to be aware of the Corporate Manslaughter and Corporate Homicide Act 2007.

The Act introduces a new criminal offense for organizations when failures in the way in which activities are managed or organized result in a person’s death. If a substantial part of the failures that the organization has perpetuated arise at a senior level, then the organization can be guilty of a new offense and liable to an unlimited fine.

Minimum holiday entitlements rise from April 2009 so that all full-time employees will be entitled to 28 days’ holiday including Bank Holidays. Previously the minimum entitlement including Bank Holidays was 24 days.
