Joseph Brant Memorial Hospital Faces Class Action Lawsuit; The First Of Its Kind In Canada
In the first lawsuit of its kind, a Burlington, Ont. hospital is about to face a $50 million class action lawsuit in Hamilton, Canada. The accused hospital, Joseph Brant Memorial is facing the class action lawsuit from all the patient families who were infected with C. difficile and died in a 20-month period between May 2006 and November 2007. Nearly, 91 patients died in that C. difficile outbreak.
Experts have said that out of 62 of the deaths, C. difficile caused or played a clear role, and contributed to 14 others.
The class action is believed to be different because of the number of people who have been affected by it and the period of time over which the C. difficile was allowed to pollinate through the hospital.
The lawsuit was filed on Wednesday. It alleges that the outbreak was preventable and the hospital’s cleaning, maintenance and disinfection practices were deficient.
The allegation has not been proved in the court yet and it needs the certification by the judge before it can go forward.
