Judge Ruled Against Condos Sell
Judge Thomas W. Cooper Jr., a circuit court judge decided against the developer of H’s Resort and Beach Club, at least temporarily blocking his attempt to re-sell units and start construction of a condominium project.
Cooper ruled against the developer’s request to remove a court action, called a lis pendens (a suit pending), filed in November against the H’s Resort property in North Myrtle Beach by dozens of people who signed contracts to buy units in the project over the past two years.
About 60 people who bought units at H’s Resort have joined a class action lawsuit against developer Harvey Graham Jr., accusing him of fraud because he canceled their purchase contracts in November and then offered to sell them the same units for a higher price.
Prices at H’s Resort originally ranged from about $260,000 to $305,000, according to court papers and buyers who signed contracts in 2004. Now, Graham’s company wants as much as 51 percent more for each unit, court records show.
