St. Louis University faces cerebral palsy malpractice lawsuit over inappropriate medical care

St. Louis University Memorial Hospital and the doctor who delivered a baby named Haley Overmeyer on January 9, 2005, faces a cerebral palsy lawsuit, due to medical mistakes during delivery.

The birth injury malpractice lawsuit was filed in St. Clair County Circuit Court in Illinois last week.

If the proper standards of medical care are not exercised by the doctors, hospital and nurses during delivery, the child could be left with a devastating birth injury. When a medical mistake is responsible for an injury to the child, financial compensation may be available through a birth injury lawsuit.

Hundreds of cerebral palsy malpractice lawsuit are filed every year pointing to specific failures or mistakes made by doctors or medical staff which could be responsible for the brain damage.

Linda Overmeyer, mother of Haley Overmeyer, alleges that Dr. William Keenan who was an employee of St. Louis University and Memorial Hospital, failed to appropriately resuscitate the child, ensure that she was properly intubated or properly monitor her. Appropriate standard care would have prevented the permanent disability of the child.

Cerebral Palsy or CP is caused by damage to the motor control centers of the developing brain and can occur during pregnancy (about 75 percent), during childbirth (about 5 percent) or after birth (about 15 percent) up to about age three.

There is no known cure for CP. Medical intervention is limited to the treatment and prevention of complications arising from CP’s effects. The life-time medical expenses to care for a child with cerebral palsy is beyond  the reach of common people.

However, improvements in neonatal nursing have helped reduce the number of babies who develop cerebral palsy.
