$4.7 Million Class Action Lawsuit Settlement Waiting for Court’s Approval

A class action lawsuit which has been filed in Dayton, Los Angeles, Calif., and Barbour, Ala., by purchasers of a sexual enhancement dietary supplement against the Cincinnati-based company that is known for its “Smiling Bob” commercials, will be asked to be settled for $4.7 million.

The proposed settlement would notify customers of Berkeley Premium Nutraceuticals and give them 45 days to make a claim if they did not receive a requested refund for purchases of the male enhancement product, Enzyte, from August 2001 through April 29, 2005, or of female enhancement product, Avlimil, from Jan. 1, 2003, through July 30, 2004.
