Class Action Lawsuit Filed Against Georgia Based Medical Record Copying Service

Kristin Miller, today, has filed a class action lawsuit against a Georgia based company, Smart Document Solutions in Phillips County Circuit Court under the Arkansas Deceptive Trade Practices Act (ADTPA). The said company provides medical record copying services for health care providers.

Arkansas code 16-46-106 says that the cost for copying medical records shall not exceed $1 per page for the first five pages and 25 cents for each additional page. A minimum charge of $5 also is listed in the state code and charges may include a reasonable retrieval fee for stored records. Kristin Miller who filed the case, alleges that the company, Smart Documents keeps its records on-site in computers and it charges a retrieval fee of $10. Miller also alleges that the company then overcharged its clients for postage.

Smart Documents, on the other hand, filed a motion to dismiss the complaint citing jurisdictional matters. Also, the company argued that Kristin Miller had insufficient facts to support each and every count of allegation in her complaint.
