Court has refused to dismiss a class action lawsuit in which Circuit Judge John Wittmayer rejected 11 of the 12 Portland General Electric motions against PGE, subsidary of the bankrupt Enron Corporation.
The lawsuit seeks $7 million that PGE charged ratepayers for taxes the complaint alleges were not paid to Multnomah County.
Dan Meek, one of the attorneys who filed the lawsuit, says the judge will consider the remaining motion he will consider on technical grounds.
The lawsuit is part of a larger dispute over whether PGE overcharged customers more than $900 million since Enron purchased it in 1997.
Last week, Portland city commissioners ordered a hearing to determine why $672 million that PGE collected from ratepayers was never actually paid to taxing authorities.
