Lawsuit for Medicare Drug Plan Seeks Class Action Status

A lawsuit which was filed by Pennsylvania Health Law Project and Philadelphia Community Legal Services in a Pennsylvania court to block automatic enrollment of “dual eligibles” into managed care plans, is seeking for class action status.

According to Pittsburgh Post-Gazette reported, about 100,000 Pennsylvanians are “dual eligibles,” who qualify for both Medicaid and Medicare. The Medicare Prescription Drug Benefit law has created a lot of confusion and sparked several legal challenges.

In Pennsylvania, most dual eligibles get prescriptions through Medicaid while relying on Medicare for most of their healthcare.
