Lawsuit over Cellphones Nixed Denied Class Action Status

SaskTel Mobility and four other Canadian cellular telephone carriers lawsuit which alleges the “system access fee” charged monthly to wireless customers had been misrepresented and falsely advertised by wireless carriers, was rejected class action status in a Saskatchewan court as the suit did not have a “suitable representative plaintiff or plan for the class action.”

The other defendants named in the lawsuit are Bell Mobility, Telus Mobility, Aliant Inc., Rogers Wireless Inc. and Microcell Telecommunications Inc.

The 44-page judgment released earlier this week also noted the lawsuit “does disclose a reasonable course of action; namely unjust enrichment.”
