Ex-transit cop accused in killing seeks new venue
SAN FRANCISCO — The lawyer for a former Bay Area transit police officer accused of fatally shooting an unarmed man on a train platform says he intends to file a change of venue for his client’s murder trial.
Attorney Michael Rains said Friday that he does not believe 27-year-old Johannes Mehserle will get a fair trial in Alameda County after a superior court judge said Mehserle meant to shoot 22-year-old Oscar Grant with his pistol, not his stun gun.
Judge C. Don Clay made the comments Thursday before ruling Mehserle will stand trial in the New Year’s Day shooting.
Rains has contended that Mehserle accidentally shot Grant with his handgun and intended to use his stun gun.
